Terms and Conditions

The general terms and conditions of sale apply to all sales of goods and services by Etyra Technology SRL through the online store https://www.robomarket.ro to the Buyer and can be modified only with the express written consent of both parties. These Terms have been prepared in accordance with applicable Romanian and EU legislation, including:

• Law no. 365/2002 on electronic commerce, as amended by Law 121/2006
• GEO 34/2014 on consumer rights

Definitions

In this document, the following defined terms will be used:

• Buyer: the person, firm, company or other legal entity that issues an Order.
• Seller: ETYRA TECHNOLOGY S.R.L., with registered office in Bulgarus Street, No. 65, Ground Floor, Office 2, Sector 5, Bucharest-Romania
Logistics/Working Office:
The company’s working and communication office is located at Str. Linia de Centură, No. 50, Block Q15, Cosmopolis Complex, Ștefăneștii de Jos , Ilfov– Postal Code: 077175.-Romania (Warehouse/Shipping Address)
• Trade Register J40/19995/24.10.2023, CUI RO 48993685.
• Goods: any turnkey project, equipment, material and/or part thereof or service, including documents and services mentioned in the Order or otherwise related to them to be provided by the Seller to the Buyer.
• Order: an electronic document that acts as a form of communication between the Seller and the Buyer through which the Seller agrees to deliver the Goods and Services and the Buyer agrees to receive these Goods and Services and to make payment for them.
• Intellectual Property Rights (IPR): all intangible rights such as know-how, copyrights, database rights, design rights, patents, trademarks and domain name registrations for any of the above.
• Specifications: all the specifications and/or descriptions of the Goods and Services as specified in the Order.

Content

For the purposes of these Terms, "Content" includes, but is not limited to:

• All information on the Site that can be visited, viewed or otherwise accessed by using an electronic device;
• The content of any e-mail sent to Buyers by the Seller by electronic means and/or any other means of communication available;
• Any information communicated by any employee or collaborator of the Seller to the Buyer;
• Information related to the Goods and/or Services and/or the rates charged by the Seller in a certain period;
• Information related to the Goods and/or Services and/or rates charged by a third party with whom the Seller has partnership contracts;
• Data relating to the Seller or other privileged data thereof.

Contractual Documents

By placing an electronic or telephone order on the website https://www.robomarket.ro, the Buyer agrees to the form of communication (telephone or e-mail) through which the Seller conducts its operations. The Order will be composed of the following documents, in order of importance:

1. Order confirmation (including clear mentions of delivery and invoicing dates)
2. Buyer's specifications (where applicable)

Assignment and Subcontracting

The Seller may assign and/or subcontract to a third party services related to the fulfillment of the Order, with the Buyer's information, without the Buyer's explicit consent being necessary. The Seller will always remain responsible to the Buyer for all contractual obligations.

Orders and Invoicing

Invoices are issued according to the legislation in force in Romania and are sent by email together with the ordered products to the delivery address. On request, the invoice can also be provided in physical format. Orders placed on working days, until 16:30 Romanian time, are shipped in no more than 3 working days if the products appear on the website marked with "shipping in 24 hours".

According to the laws in force, the order placed on this website is considered a contract between the user and Etyra Technology SRL and must be executed by both parties. This means that Etyra Technology SRL undertakes to deliver the products and services ordered, and the user undertakes to pay the value of the order.

To place an order, it is necessary to accept these Terms and Conditions. You cannot complete an order without checking the box to accept these terms.

Prices

We reserve the right to change the prices displayed on the website when we deem it necessary. If products with 0 price or unrealistic prices appear on the site following import or technical errors, customers who ordered those products will be notified that their order will be changed or canceled, as the case may be. This is based on Art. 1665 (Fictitious or Ridiculous Price) of the Romanian Civil Code.

Third-Party Services

Etyra Technology SRL uses the services of other companies, for example for transport and payment processing. The Seller remains responsible for the performance of the contractual obligations.

Governing Law

This agreement is governed by Romanian law. Any disputes shall be settled amicably or, if necessary, before the competent Romanian courts.
